Hello, two of my phones (iPhone 11 and iPhone 14 Pro Max) have been confiscated
The 14 has iOS 17 developer beta and the 11 has iOS 15 I think.
My question is, can they the access my data so that they are running these operating systems? Thanks in advance for any answers!

Confiscated by whom? Do you have a passcode on the phones? If so, unless the passcode is discovered, no.

Unless you are a high-profile activist, journalist, or politician whose data would be worth hundreds of thousands of dollars to acquire, I would not be concerned. But, consult your attorney.
iCloud has nothing to do with which operating system is on your phone. You really need to consult an attorney.
The police confiscated it, there is a password on both phones, I didn't tell them the code.
