Is Siri responding to you from the lock screen? What are the specific types of questions that Siri requires that you unlock the phone for? There are some things that you will need to unlock for.

They look identical to me so, I'm not sure what you think is different.
I suggest that you start by updating to the most recent version of iOS which is 16.6.1.
