To remove Activation Lock, you need to know the Apple ID and Password of the person who originally set up the phone.

The phone is going to be useless to you unless you can obtain this information. Return the phone for a refund in that case.

NEVER buy a used iPhone unless it powers up to the "hello" screen. Even then, you have no way to know about the condition of the battery.

Getting into a Logged-in Device:

A. Request a Refund:

Seems you've been scammed, though a full assumption on my part. So, ask this person for a refund. This is the site they should have used prior to handing it down to you: What to do Before you Sell, Give Away, or Trade in your iPhone, iPad, or iPod touch - Apple Support. If they don't log out of it themselves, then you'll never be able to log into it on your own account. They should have known better.

B. Report this:

Where was this purchased? If from a Web site (i.e. eBay or Amazon), then contact the site, seeing if the seller can be held accountable, and if you can get your money back.

C. Learn from This:

Next time you go about purchasing a device from someone, request that they let you log into your own iCloud account on it, prior to handing over the money. If they decide to disabide by those rules you've set forth, then do not proceed with the transaction.

If the phone is Activation Locked, you just bought a brick.

Activation Lock is an anti-theft measure. Apple will only help you bypass it under very specific circumstances, e.g., if you are the original owner and have proof-of-purchase documentation that satisfies them. Or perhaps in the case that the phone belonged to a family member, and you have an official death certificate and official court documents granting you access to their estate.

If the owner parted with the phone willingly, they should have prepared the phone for sale, following the steps here:

What to do before you sell, give away, or trade in your iPhone or iPad - Apple Support

Then it would not be locked (Activation Locked, anyway – carrier lock is a different matter), and you would not have run into the "unable to login" issue.

If you buy a Certified Refurbished iPhone – directly from the online Apple Store – then according to Apple, it will come with a new battery.

There's also presumably little or no chance that the phone will be Activation Locked.
