Asking on behalf of my friend who is unable to update to tvOS 17. He has tried restarting the device as well as a complete factory reset however each time he tries to update, the message is 'Your Apple TV is up to date'. I have the 3rd generation model and updated without issue.
As a developer, I have the beta update enabled. I was stuck on 16.6 for a while. Disabling/Enabling Beta Updates allowed me to select the 17 option right there. You can disable it later on when you make the jump. It's a weird glitch.

Just ran into this myself. For whatever reason, the Apple TV won’t update past 16.6.
Heres a potential workaround: when you enroll in the beta updates, it forces a check of the current OS. Upon selecting the TVos 17 beta, the 17.1 update began.
If it were me, then I would contact Apple Support staff about that.
