It really depends on the software of your old phone. If its not on at least ios 16.7, there's a decent change it won't allow the back up/restore to new iPhone. Make sure phone is on wifi and on the charger, to go the settings, general - "iphone storage" and see how much storage you're using on the older phone. If it's above 50GB, then yeah, it isn't going to allow a back up because it still isn't enough space. Depending on the age of your old phone, I would recommend still logging into your apple ID but not transferring apps and data over. You will still get your photos (as long as they were previously backed up) and your contacts, but you won't get your text messages transferred. If there's no backup whatsoever, I would recommend using Airdrop to transfer your contacts and photos over instead of trying to move EVERYTHING from old phone to the new phone.
