Book purchase can't be included in library on another device with same account

Here's the bottom line. Contrary to my prior beliefs, book purchases are not "forever". I bought the book 2 years ago. Since then, the book has been removed from the bookstore. My iPad broke and because the book is no longer in the bookstore, I can't download it to the replacement iPad. There is a paragraph in the Terms and Conditions that covers this case and basically tells us that we're out of luck.

If you buy a book on Monday and the book is removed from the Apple bookstore on Tuesday, then you'll only be able to use the book on whatever device you downloaded it to on Monday. No family sharing. No multiple devices. No compensation.

For you Southpark fans, we're calling it a "human centipede" clause.

Lesson learned: Don't believe the hype about electronic media. Buy physical media.

Thank you for the suggestion but the books that I'm referring to do not appear in the list of books to download. That is the problem. It's as though those books were never purchased.
