Do a web search on how to convert your own music into ringtones for iPhones. It’s a fairly simple process and a few different ways to do it. You do need to actually own the music being used (not from streaming services downloaded to your device for example).
No. It just has to be songs you paid for but are not protected ones (like how iTunes purchased music used to be AAC Protected a long time ago…those can’t be used unless you convert them. But the ones that are labeled as Purchased ACC can be used. Just an example).

It also means you cannot use a subscription in the process. For example, you cannot use a tone that originates with an Apple Music subscription - subscribe to Apple Music, produce a ringtone from one of those songs, etc.
