I’m stuck on terms and conditions and the agree button is not letting me agree

Some ideas and options—

scroll to the bottom, like you read it...then click continue...

go back and see if you can skip that part, and continue...

set up that part later...

Sign out of AppleID if necessary and back in...

use another device to sign in or out of AppleID to agree to the new terms there...

There was an issue for some when they tried to reinstall older versions of macOS (I could not remember which versions had this issue.) The trick is to go back one or two screens in the setup process and not enter your Apple ID (choose "Not now" or something to that effect.)
