Could My NEW iMac Computer have been used prior to shipping from Apple and still Sold As New?

I ask because I was confronted by pornographic pictures when I opened Photos for the first time. It should have been unused. It clearly wasn't.

And today whilst working on editing and uploading a video for the first time I found an additional Network Connection.

Needless to say I am very uncomfortable with what I have been sent. Do my consumer rights entitle me to insist Apple provide the "unused" New Computer I paid them for?

iMac 21.5″, macOS 13.0

If you indeed purchased it directly from Apple you can return it for any reason within 14 days and get a full refund. See Returns & Refunds - Shopping Help - Apple for more information.

Did you buy this as truly new or as a refurbished iMac? Refurbished Macs are supposed to have had "a rigorous refurbishment process that includes full functional testing" and come with a 1-year Apple warranty. Many people consider them to be "new" but they are, technically speaking, not new. I too once encountered an Apple refurbished Mac that showed signs of its previous owner ... clearly not completely refurbished to factory-new condition.

If not purchased directly from Apple, contact the seller about return & refund.

Had you migrated your previous account(s) and logged in to your Apple ID with this new Mac? If so, depending on how you have configured Photos, it might populate with images from your iCloud Photos. It sounds like these are not the images you were expecting to see? After migrating and logging in to Apple ID, Photos often comes up populated with images from the Apple ID account.

If none of this applies to you, I would exchange the Mac at the Apple Store as others have suggested.
