It is always best to buy a phone in the country in which you will be using it most of the time.

A phone purchased in the U.S. will likely have no warranty coverage in Germany, or any other country for that matter.

The phone will probably work in Germany if there are carriers there that support eSIM, but here again, if you have a problem, there will be no help from Apple.

When you say "will I have to pay any penalties for brining [sic] the iPhone from US to Germany," are you referring to customs, import, or VAT taxes?

If your government requires you to pay those taxes and fees, and you try to evade them, there might be penalties – both of the monetary sort, and of other sorts.

Furthermore, note that taxes work differently in the U.S., and in European Union countries, including Germany. My understanding is that in the European Union, VAT (Value Added Tax) is built into the cost of products at every stage of production, so by the time you buy them at retail, the price already includes the tax. In the U.S., sales taxes are a form of State (and sometimes local) tax that gets added on to the price of the product.

If you buy a phone in the U.S., and take it home to Germany, it is very possible that you will end up paying both U.S. sales taxes and German/EU customs/import/VAT fees. This is something that you would need to check with proper legal authorities.

On top of it, you would have a phone whose cellular radio hardware might have been designed with the bands that U.S. carriers use in mind, and whose warranty would not be valid in Germany.
