Unless you had Advanced Data Protection enabled, your photos are not End-to-End encrypted and theoretically, Apple could access them. However, the practical reality is that 1) the photos have been deleted. I don't know what that does to Apple's ability to access the data. Once you delete something from your phone, it deletes it from all of your devices (assming you're syncing). 2)I don't think Apple will unencrypt the data without a court order. But you could certainly contact Apple and ask. There is a support link at the bottom left of every page in this forum.
Standard data protection
Standard data protection is the default setting for your account. Your iCloud data is encrypted in transit and stored in an encrypted format at rest. The encryption keys from your trusted devices are secured in Apple data centers, so Apple can decrypt your data on your behalf whenever you need it, such as when you sign in on a new device, restore from a backup, or recover your data after you’ve forgotten your password.
If you did have ADP enabled, they photos are inaccessible to Apple.
