I gave an old friend a phone to use and havent heard anything from them i am trying to reset or complete lock it out it was my first iPhone xsMax, i cant see it on my find my but it is in my backed up portion

If you cannot see the phone in Find My, there is unfortunately nothing you can do in the way of locking or erasing the phone.
If you are still paying your carrier for monthly service though, you could cancel that monthly fee and have the carrier "blacklist" the phone, so that it would not be usable.

If this person is an "old friend", you might try contacting them – instead of waiting for them to contact you first.
