As you will discover, unless you are the owner of the AppleID that was last used to activate the device, you’ll not be able to defeat or bypass the Activation Lock. You will know that a device is ready for you to use when you're asked to "Set up your iPhone," “Set up your iPad," or “Set up your iPod” the first time you turn it on.

I'm guessing what you're trying to say is that it's activation locked with someone else's Apple account.

Assuming that's true, you don't. It's useless. Return it and get your money back if you can. There is no way to bypass the activation lock. It's an anti-theft feature. The device was not properly prepared for sale.

Is there a passcode on the device?

Is there an Apple ID already signed in?

If you can get into Settings, check if there is a name listed at the top. If not try going to Settings>General>Transfer or Reset>Erase All Content and Settings
