My husband has had a new iPhone we transferred all data from old iPhone. The new phone is now saying there’s no storage. We have gone int back up file and it’s still backing up his old phone. If we delete it of the device will he lose all his data

So, he set up the new phone using the backup of his old phone?
Then, when setting up using the backup he received a notice that his device was out of space? (That doesn't look like what is being shown).
If the new device is already set up, he can delete the old backup.
Or, are you getting a notice from iCloud that he is out of space? That's possible given that the old backup is 37GB and the new one significantly smaller; probably more backup to be done and more space needed in iCloud.
Yes that’s how we set it up, we are currently backing the new phone up. So with the new phone all set up and all data on the new device by removing the old device it won’t delete anything off the new phone will it. We have purchased extra space via the apple subscription
