Time Machine restore is larger than new Mac harddrive

My 2019 MacBook has died. My new MacBook only has a 250GB HD. My Time Machine file is 300GB plus. Is there anything I can do without loosing data?

The files I want are my documents and desktop folders from the old Mac.

I have tried safe mode and recovery mode with the old Mac. Seems to be a hardware problem.

Refer to Transfer to a new Mac with Migration Assistant - Apple Support. Click the "reveal triangle" next to the username whose contents you wish to migrate, and you can then choose from among broad categories of items to transfer.
