Basically, the device is enrolled in MDM when it is turned on for the first time, before anything else happens. This easily side steps the Stolen Device Protection issue.
No. This shouldn't be an issue if you purchase through an authorized reseller and use automated device enrollment.
Can you give more details? We are finding that this is an issue. When you try to install the MDM profile it makes you wait an hour. I've seen this even from a "known" location such as the office.
