Yeah, you can definitely own it, but if your watch is sold In the USA, apple removed the functionality in the software. I have a watch bought in Europe and live in Europe, and the O2 measuring is still working here
The US Federal Court ruling on prevents Apple from importing Watches at violate several specific patents. Therefore new Apple Watches do not contain that feature. Watches imported and sold prior to the effective date of the ruling are exempt and may be bought and sold.
The US Federal Court has no jurisdiction outside the US.
