Request for Remedy Regarding Apple Watch Ultra Replacement and Downgraded Features
Dear Apple Customer Service Team,
I am writing to formally address my concerns and request a resolution regarding my Apple Watch Ultra (Case Number: 102450101801, Repair ID: R638579384). I purchased this model with AppleCare over a year ago, specifically for its advertised features, including the Blood Oxygen Level (BOL) functionality. However, due to recent developments, Apple no longer supports the Blood Oxygen Level feature in replacement devices of this model, resulting in a downgraded functionality upon repair or replacement.
Recently, my Apple Watch Ultra’s back glass broke. When I visited an Apple Store to replace my device under AppleCare coverage, I was informed that Apple would replace my device with the same model; however, the replacement would lack the original Blood Oxygen Level functionality. This was despite the fact that I have been paying for AppleCare for over a year, expecting continuity in the feature set for which I initially purchased the device.
My Concerns:
Downgraded Functionality: I paid for a product based on its specifications, which included Blood Oxygen Level monitoring. Downgrading to a device without this feature affects the fundamental utility of the product I purchased.
Loss of Value: As a loyal customer, I have invested in the AppleCare package expecting full coverage and functionality preservation for my Apple Watch Ultra. The replacement being offered lacks an essential feature, which reduces its value compared to the device I originally purchased.
Lack of Alternative Options: I was informed that I must accept this downgrade as a condition for repair, leaving me no option but to comply if I want my watch replaced, despite my legitimate need to retain the features originally advertised.
Requested Remedy:
In light of the above, I respectfully request that Apple provides a replacement that:
Retains the original feature set, including the Blood Oxygen Level functionality as advertised at the time of my purchase; or
Offers an upgraded model (e.g., Apple Watch Ultra 2), ensuring that I receive a device with comparable or enhanced functionality to the one I initially purchased.
Compliance with California Consumer Protection Laws:
Given that California consumer laws protect buyers from deceptive practices and mandate that companies must honor the specifications advertised at the time of purchase, I am reaching out with this formal request for a remedy aligned with the Consumer Legal Remedies Act (CLRA), Cal. Civ. Code § 1750 et seq., and California’s Song-Beverly Consumer Warranty Act, Cal. Civ. Code § 1790. Apple’s modification of an essential feature post-purchase and offering a replacement that lacks such functionality raises concerns under these protections.
