im confused on why my phone is opening with my eyes open or closed … so my real question is when would that be fixed??? My phone should not be opening with my eyes closed!!

Do you have Require Attention for Face ID and Attention Aware Features enabled? Follow this path,
iPhone > Settings > Face ID & Passcode > enter passcode > enable both features mentioned above.
Require Attention for Face ID requires your eyes to be open.
Attention aware features isn’t required, but I like the brighter screen at times.

There is nothing to fix. Facial recognition maps out the surface of your face with a low powered laser, it does not do a retinal scan. Your eyes don't need to be open.

You are correct, it shouldn't. However, why is an unknown. I suggest you try powering the phone off and back on again and see if that corrects it. Next, how would you know that it is opening with your eyes closed, if they are closed. If you open your eyes, the phone can still see that while you are trying to open it if you look. If you give the phone to someone else for them to try and open it, see if they can open it without you being around the phone. If that can be done, then I suggest that you reset the Face ID.
