AirPods Switch Noise Control Modes(and more)

I have had AirPods Pro 1 and 2. Currently iPhone 15 Pro Max and M1 Air.

I turn on Noise Cancellation and also Noise Cancellation with 1 AirPod in Accessibility on all my devices.

Both model AirPods routinely switch to Transparency if I force switch between devices and often if I take one AirPod out of my ear. Ear Detection is off. Apple offered 0 support.

Anyone know of a fix before I return the Pro 2?
