Activation Lock is intended as a theft deterrent, and is intentionally difficult to bypass.

The owner of this iPhone XS will need to release Activation Lock, or provide you with a purchase receipt, or you have yourself a brick.

If this was your Apple Account, you will need to recover account access, or provide proof of ownership.

Apple usually expects either the original purchase receipt or similar documentation as evidence, or the owner will need to release the lock.

This release of ownership can be done remotely, as described here:

What to do before you sell, give away, or trade in your iPhone or iPad - Apple Support

Nobody here can help release Activation Lock. Absent convincing proof of ownership, Apple won’t help.

roubleshooting a Locked iPhone:

Seems you have a locked iPhone. So, contact Apple Support. Refer to the following...

Hold It Right There!:

Enter the passcode incorrectly too many times, and you'd likely be locked out for good. So, hold it right there, and refer to this link: If you Forgot the Passcode on your iPad, or your iPad is Disabled - Apple Support. It would be the one you've always entered. If you do not know it, then look for it in a location you may have stored it in.

Being Locked Out...

Have any Proof of Purchase?

Unless you have the original packaging and receipt, you may be out of luck. If you do have it, however, then take this to an Apple Store, or an AASP (Apple Authorized Service Provider)! and they may be able to restore it. The reason for this blockage is all about Security & Privacy.

What you are referring to here is unclear to me.

If referencing the Activation Lock (this thread) theft deterrent, see my reply above for more about Activation Lock.

If some other “unwanted software policy privacy”, please provide some more details and some background on what you are referencing.
