How to remove another person's iCloud account from a used iPhone 5?

Someone give me an all device in iPhone 5 and it’s still logged into the persons iCloud account. I can’t contact the person. and I don’t want to. Reset that person‘s Apple account password? Is there anything I could remove it?

Activation Lock is intended as a theft deterrent, and is intentionally difficult to bypass.

We can’t help, and — absent ownership proof you won’t have — Apple won’t help.

Beyond the limits of an ancient iOS version, this iPhone 5 is forever useless to you.

Recycle it.

The phone still works. I haven’t reset it but I want to set it up under my account.

To re-state your question, you are seeking to gain access to an iPhone with Activation Lock set.

This particular question is quite familiar, as it gets asked a whole lot.

When you want access to an iPhone with activation Lock set, you will need the assistance of the person holding the credentials to the Apple Account associated with Activation Lock to release the lock, recover access to your own Apple Account if that is the account holding the lock, or you will need the original purchase receipt or other evidence sufficient to convince Apple of your ownership.

Absent that, this case is indistinguishable from a lost or stolen device, if this device is not actually lost or stolen.

This because Activation Lock is intended as a theft deterrent, and intentionally difficult to bypass. We can’t help. Absent convincing proof, Apple won’t.

With no access to the Apple Account and no proof of ownership, you are left to recycle it.

This is the third time you have asked this same question, in this same thread.

Otherwise, recycle this iPhone 5, as it will remain less than useful.

Sorry, you're out of luck and will not be able to remove the previous owners account. That requires their password or they can remotely remove the device from their account, but without their assistance you will not be able to completely use the device as yours.

Also be aware that you now have a personal tracking device and the owner can monitor your movements if they wish and may even have access to any data that you are currently storing in iCloud.
