Apple Pencil disconnects as soon as taken off ipad

Just bought a second hand Apple Pencil gen 2 that I was told was brand new and never used. Connected to my iPad before handing money over and got home and it didn’t work. I realised that it’s disconnecting as soon as it’s taken off the side of my iPad. I’ve tried forgetting the device and resetting my iPad and even making sure the iPad was updated to the latest update and it still keeps doing it, the pencil doesn’t seem to go higher then 59-60% charge..
