Apple Pencil 2 not working on my Ipad Pro 11 inch 3rd gen

Just purchased the Apple Pencil 2nd generation to use on my Ipad Pro 11 inch 3rd generation and it won't work out of the box. I connected it to the magnetic charger on the Ipad, the pencil battery percentage pops up at 58% and appears to be connected to my Ipad on Bluetooth. However, when I lift the pencil off the Ipad to use it, it disconnects from the bluetooth and just wont work. I have left it to charge now for about an hour but the battery percentage of the pencil is stuck at 58%. I've tried updating the Ipad and performing the forced restart and nothing has changed. I'm guessing I have a dead pencil?

I noticed a post from a few years ago concerning the same issue with the top reply offering a few tips (all of which i have followed) and stated if these did not work you have a dead apple pencil with no choice but to replace or buy new. Is this still the case?

Your Apple Pencil is exhibiting symptoms of a failed battery - that will not reliably accept or hold any charge.

The tiny internal Li-ion battery is susceptible to permanent/irreversible damage through being left discharged for long periods. Even some “new” pencils can exhibit signs of failure out-of-the-box if they are “old stock”. It is essential that if you have an Apple Pencil that you charge it regularly - whether used or not - so as to protect the battery from deep-discharge. Do not allow a pencil to remain in low-charge state for any period of time - as the internal battery will fail, rendering the Pencil useless. Setting aside an unused Pencil, for extended periods, is a recipe for premature death of the Pencil battery.

If the Pencil Battery has failed, the only remedy is to replace the Pencil. If the battery has failed and your pencil is within its one-year warranty, you should look to having it replaced by your retailer or at an Apple Store.

You would be best advised to visit the Genius Bar at your local Apple Store or Apple Authorised Service Provider (AASP) - where the technicians will be able to test and assess your iPad and Pencil. If a fault is identified, you’ll be in the best possible place to explore your available options:

If the Pencil was purchased new directly from Apple, in most countries you have 14-days within which to unconditionally return the item for exchange or refund.
