iPod touch 5th gen iCloud locked, owner's number disabled

Hi, I bought a ipod touch 5th gen awhile ago from trade me (think ebay but for nz) the icloud is still on locking me out. the message from the owner has their number in it which is dissabled and I dont know where to go next
