FileVault not being enforced in Apple Business Essentials?

We're using Apple Business Essentials. We have a policy that all devices need FileVault enabled (and we uploaded a FileVault private key). Despite this, a few devices (roughly 15%) show "FileVault Turned Off". Why is that and how can we strictly enforce FileVault?

If you’ve followed the instructions, and if the Macs are recent or current macOS:

Check with Apple Support.
