Mac mini data transfer from Mojave to new: OS mismatch

Would like to buy a 2024 Mac mini Desktop Computer with M4 chip. Currently I have a 2012 model Mac Mini that won't accept a Mac OS any newer than Mojave 10.14.6. Instructions for using the Migration Assistant specifies that both new and old units have the latest OS installed. Well, my old one won't take the newest version. So, how do I transfer data ... can I still use Migration Assistant?
