To put a positive spin on this despite what others are telling you about warranties etc., I would think you could at least have somebody at an Apple Genius Bar take a look at it and tell you what the issue may be, even if they are then unable to do anything about it.

How to make a Genius Bar appointment
1. Go to Genius Bar Reservation and Apple Support Options - Apple
2. Go to "Get hardware help".
3. Select your hardware and continue selecting options requiring replacing parts until you see "Bring in for Repair"
4. Sign in with your Apple ID
From what you says in your first post though about not even seeing the settings option, I am wondering if this was truly a "new" iPhone and you instead bought a used one that still had some settings from a previous owner.
