On models that have Apple Intelligence, you can go to Settings>Camera>Launch Visual Intelligence and turn it off. That keeps the side button from opening Visual Intelligence. Personally, I never use that button, anyway, so the problem doesn't come up.

On my iPhone 15 Pro, I went to Settings/Camera/Preserve Settings/Creative Controls, then turned it on.
Then I opened the camera, changed the aspect to 16:9, and took a picture.
Then I restarted the phone. Now, the camera always opens in 16:9 ratio.

I'm glad you fond an answer. I'm not sure how this is connected to Apple Intelligence, though.
The aspect ratio of the sensor itself is 4:3-- you always get 4:3. To get 16:9, the phone just chops off the top and bottom. I use 16:9 a lot, but I but use the cropping feature in the editor to decide for myself what to cut off.
When I opened the Phone app today, I was asked if I wanted to turn on Visual Intelligence. After that, AI took over and I couldn't see my regular Photo controls. I was just getting trying to get rid of Visual Intelligence
