To fix a greyed-out "Agree" button during the El Capitan setup, skip the iCloud/Apple ID sign-in step, complete the setup to reach the desktop, and sign in later through System Preferences.

Typically you might scroll to the end of the Ts&Cs and that would enable the button.
Have you tried the Back button and then reentered this screen?
yes and still
I was able to press the agree button without scrolling on the skipping the Sign in on the Apple ID Step
