Yes, you have been scammed. The phone you purchased was stolen and belongs to someone else. You should report the seller to the website you purchased from. If it were me, I would also report the seller to the local Police. There is no solution to your problem.

You have very likely been scammed. Getting an Activation Locked phone is almost always a sure sign you were sold a lost or stolen phone.

You could try contacting the seller to get the information you need to unlock it, but don't be surprised if you get no response, or claim they don't have, or "forgot" their own user name and password.

No. Apple will not help to remove that. Activation Lock is a safety feature.

Activation Lock is an anti-theft feature to protect the interests of the owner whose Apple Account is associated with the phone. Removing Activation Lock on second-hand phones would defeat the entire purpose of the anti-theft lock.
