Trash problems because the "item is in use"

Hi folks.

We're having a strange problem with our XSAN - there are some files stuck in the trash. Whenever we try to empty the trash we get the message "The operation cannot be completed because the item is in use." Force emptying the trash doesn't seem to help.

We've tried turning off all the seats so that only the MDC is running and then emptying, but the files are still stuck. They are definitely not in use. Any ideas?

We're on XSAN 2.2 and Mac OS 10.5.8

I have 3 folders and 3 separate items in the Trash and no matter how I attempt to "empty the Trash" I get the following messages in this order: First- There are some locked items in the Trash. Do you want to remove all the items, including the locked ones, or just the unlocked items?
Then no matter whether I select remove all items or just the unlocked items, I get this message next: The operation can’t be completed because a required item is in use.
and all of the folders and items remain in the trash basket. Not only that but I cannot remove them from the trash nor does "put back" have any effect. I tried the Script editor idea and it had zero effect. Suggestions welcome,,,
