Could not replicate the issue...

So I sent in my iPhone 4 the other day, and today i've recieved an email saying sorry we could not replicate the issue.
Now I sent my phone in because it had an intermittent fault/s, maybe apple dont understand what that means... or maybe they just dont want to.
Anyway, i've had my rant, the phone was sometimes overheating, and i mean overheating, it was hot to touch, so god knows how hot the inner parts were, however what is worrying is i didnt even get the temperature warning. This happens every now and then, and must be causing internal damage, if not that, a fire risk.
The battery has also diminished thouroughly. To the point where it doesnt even last half a day, when i used to get atleast i day out of it.
Also the phone is failing to send/recieve texts to specific recipients, this may be a carrier issue, however if it is not, how can apple test the phones messaging capabilities to the people I have been messaging. So of course they wont replicate the issue.
What should I do? My phone needs fixing, but Apple aren't helping.

Nearest genius bar is two hours away, maybe ill just keep sending my phone in until luckily it will happen during their "diagnostic." One thing that is not intermittent however is the fact that battery does not last anyway near the 300 hours on standby Apple claim. Mine lasts 24 hours, and this was with Wi-Fi 3G data... everything turned off. I stated this, and yet they still send my phone back.

Forget getting through to Apple. The problem is that there is some app on your phone that is continuously trying to connect to a server and failing. It's a fairly common problem, and to fix it you need to identify the application. Apple can't do that. You need to. As a start, connect the phone to iTunes and sync to create a current backup, then go to Settings/General/Reset and tap *Erase all content and settings*. Then connect to iTunes and do a Restore, and set up as a new phone. Don't install anything yet, or even enter email accounts. Don't launch any apps. Fully charge the phone and then just let it sit for a few hours. If it uses more than 1% or 2% of the battery then there really is something wrong with the phone. But most likely it will be well behaved.

Assuming it passes this test you can try restoring the backup. If it still works it is fixed. If it doesn't, do the Restore again and don't reload the backup, which is corrupt. Create email accounts and nothing else. If the problem returns you have a problem with your ISP's mail server. If it doesn't start adding apps back a few at a time. You can narrow down the problem this way.

Did you do it as I described, erasing all content first, and not setting up anything, so it is essentially as it came out of the box? And don't turn everything off; leave it on. With no apps or email accounts the only activity should be periodic registration with the cellular network, which uses very little power. Sometimes turning things off makes it use more battery, as apps keep trying to communicate.

how do i talk to a senoir advisor, or do i need the sapple care programme so that i have telephone support?

Absolutely not.

Assuming it's under warranty.

You just need to call the same number you called before to set up a repair.

Speak politely with the agent and explain that you have tried a repair, the issue was deemed irreproducible and that you wish to contest this.
Tell them that you feel very frustrated with this issue and you no longer wish to accept this level of performance from the device.

If they don't offer to set up an exception so that the phone is replaced next time you send it in,

Tell them that you would like to speak to their manager, they will put you onto a senior advisor, again be polite and tell them the same thing.

That you're not happy and you want resolution to this issue as it's a very real problem for you.

I've found the Apple tech support to be very easy to deal with on the whole so I'm sure they'll have no problem sorting you out, I guess they have that policy of sending back iPhones that they can't reproduce the issue with to worm out the kinda people who send it back over nothing.
