i dont sync the photo file on the iphone.

No one does. Photos in your camera roll are not synced through the iTunes sync process. Photos in your camera roll are only included in the iPhone backup. So, if you don't sync your phone, as already provided, there is no backup with which to use to recover these photos.

if theres a way i can recover the files directly from the phones hard drive with data recovery software.

First, the iPhone does not have a hard drive. It's flash memory. Second, there is forensics software that "may' be able to recover files from the iPhone, but the software & hardware required to do so is expensive. One of the best in the business is this guy:

However, he only provides his services to law enforcement.

Unless you have an iPhone backup to try and restore these photos, I suspect you can consider them gone.

If you have back up your photos, you can restore from the backup.

To restore information from a backup, use one of the following methods after connecting your phone to the computer with which you normally sync:

1. Right-click (or Control-click) the device and choose Restore from Backup

2. If you have a new phone, you can connect to iTunes and it will prompt to restore from your backup

Well, iPhone use quite different storage media which means once you deleted stuff (such as photos, videos etc) off it, it's just gone and can't be recovered with general free Mac data recovery software like TestDisk or PhotoRec.

Next time, remember to back up everyting regularly in case any similar suffering happen.
Hope this helps.

You need to check whether you have the backup already. As I know, iTunes can automatically backup data when you sync your iPhone every time unless you manually stop it. So check the backup first

Launch iTunes

iTunes > Preferences > Devices

the photos and videos should be there if your iPhone is not overwritten. so recover deleted photos from iPhone via the backup files..

If you are unlucky, there are no pics backup.. U may rely on some software to help you.

As a matter of facts, Photos and Videos are retrievable from "Recently Deleted" album within 30 days after being deleted, which means that you can recover your photos as long as they are not yet overdue.

However, in the case that photos were deleted over 30 days. It's technically possible to get them back given that you have no backups.

I've been in trouble with the same problem as you are now. I've tried iPhone Data Recovery on iFoneTips and it did scan out those photos. Hope it works. Good Luck!
