If it is not opened, likely you will be able to return it for an exchange but not for cash back. But they don't have to do it. Can't hurt to try it. Ask whoever you got it from for the receipt.
I know a few people who have done it an an Apple store.

Carolyn I don't in the link you provided that you need a receipt to return an Apple purchase. I have return Apple products for warranty work without a receipt.

I called a local Apple store here in the bay area. They will do this with a copy of the email confirmation if the person does not have the original receipt.

They can check to see if warranty work is covered regardless. The OP is talking about an exchange.

Note that repair under warranty is not the same as returning a purchase.

They don't need to do it.
It is simply good customer service which. Apple is known for outstanding customer service.

The policy says you cannot return without a receipt but managers are given leeway in their own stores.
And they are usually more easy going about it with a new released product.

You also should verify which whoever gave you the gift that the iPad was purchased from an Apple Store. If it was purchased from another reseller, the Apple Store will not allow a return. This is why obtaining the receipt, if at all possible, will be very helpful.

I would really try to find out - can't you ask the person who gave it to you? Explain the situation and why you need to know. I would imagine that Apple will be MUCH more reluctant to return an iPad without a receipt - for one thing, they would have no proof that you bought it within the 14 day cycle.

It is possible they won it or got it in return for buying something (like a car) which would leave them without a proof of purchase. If that was the case, enjoy your iPad 1. It's still a great product.

You can attempt to take it back to Apple, but don't be upset if they don't take it. They don't know if you got it for $399 and are now trying to get $499 back. They also don't know if it came from Best Buy, Fry's, Wal-mart or somewhere else.

Nothing other than sell it outright. Without a receipt showing where you got it and when, no store is going to take it back.

Or you can just use and enjoy it. The iPad 1 is still a great little machine.

The Apple store will know who brought it and where it was bought by the serial number on the box. When I retuned an iPad for warranty work they typed in the serial number and my name, address, how much I payed for it and where I bought it (Best Buy) popped up.
