Try a System Reset:
Hold down the on/off switch and the Home button simultaneously until you see the Apple logo. Ignore the "Slide to power off" text if it appears.

Thanks, that didn't seem to help though. It's very weird, I've since found a few (third party) apps that pay attention to the volume setting, but most don't, certainly none of Apple's do.
Never had this problem on an iPod or iPhone before... But this is my first iPad.
The sounds doesn't play when I'm playing a game. How do I fix this? Going to Best Buy tomorrow to have mine replaced with a new one. This is kinda disappointing.
I am having the exact same volume issue. Methinks it's a bug. Only thing that actually mutes the volume is the mute switch. Turning down the volume has no effect. That ***** if you want to use your mute switch as an orientation lock.
Same issue here. lowering the volume until it should be muted has no affect on apps, unlocking noise, etc.. If in preferences switch the mute/orientation switch to mute it will work to mute. But I want it to be orientation lock.
Volume rocker works with music, just not apps/ipad system.
