can someone else use my old iphone as a regular phone

My mom had an iphone and decided she did not want it. So she gave it to me. Question is can my husband put his SIM card in the phone and use the phone as a phone? He will not have the data plan for it he just wants to use the phone for a phone

Here's the deal: most carriers require that iPhones using their network have an associated data plan. So, check with your carrier to see if they will permit an iPhone on their network without a data plan. If your carrier says yes, you can swap the sim in the phone no problem. Carriers can tell exactly what type of phone/equipment is using their network by the device's IMEI number.
