Ipod touch Model Number MA623LL

Ok so Trying to download the free angry birds, which I used to have until I restored my ipod to clean it all out first time since I first got it. And lo and behold back to 3.1.3 which wont allow me to run free angry birds and various other apps. I could have sworn before that I had at leave ios 4.0. any insight would be helpful.
