Move to Trash deletes straight away
Previously the command was (and still is) labelled Move To Trash and not Delete Immediately...

mkdir ~/.TrashIf you get a message that the folder already exists, copy & paste these commands...
sudo chown $UID ~/.TrashPress return
chmod u+rwx ~/.TrashPress return. Log out and back in, or restart.
Same issue with instant delete. When I type in mkdir ~/.Trash, I get a response that Command not Found.
What does that mean? Should I proceed with your 2d steps anyway?
