It should remove with ⌘-drag. (not just ⌘-click). The change from simply dragging off was introduced in 10.6.7.

If it still won't move, try removing the com.apple.finder.plist from your user/Library/Preferences folder to the desktop and relaunch Finder (Press ⌥+⌘+ESC to bring up the force quit menu, select Finder and click relaunch).

If that works, trash the .plist (a new one will already have been created, but you'll need to reset all your Finder preference setings); if not put the .plist back in the prefs folder (replacing the new one and saving the bother of resetting the prefs).

The cmd-drag was added at the 10.6.7 update. Apparently in response to many people accidentally dragging them off.

It's always been the way to remove items from the right side of the menu bar, so it makes some sense. It would make even more if they did that with the Dock.

It would also be helpful if they actually told us in the update notes of course, but there you go…
