Can anyone help me with this legit from a pawn shop and i cant download some apps because i dont know the apple password any help would be greatly appreciated, this is very frustrating just spent a bunch of money on a used one and should have spent the little extra and got the new one but i didnt so im stuck with this, so someone please help me

It should have been restored but this doesn't seem to be the case. You will need to set up your own Apple ID and account and then you can sign out of the old one on the iPod via Settings>Store>Sign Out and then you can sign in with your new one when that is set up.
The only "Apple password" would have been the previous owner's iTunes account password, which is not for you. You'll need to create your own Apple account before you can download anything, even free items require an account to be created.
If i created the account how would i get it on to the i touch its self?
Once you establish an account, you'll need to have iTunes running, be logged into your account, and then Restore the iPod to factory settings (which will erase it). Per your other post, you're not authorized to have whatever content was on the Touch when you bought it.
