There is no way to locate it if the phone is off. Even if the phone is turned on, anyone can just restore it as a new phone to wipe the settings and you won't be able to locate it with Mobile Me. You should report your lost device to your carrier to avoid any unwanted charges and to deactivate the SIM.

Theoretically, yes. However, in practicality, most law enforcement agencies will NOT do so. Not worth their time.
