do I get a new Generation iPod replaced?

My iPod will freeze or shut down automatically and will not turn back on or sync with the Computer. The only way to get my iPod touch back up is to Reset by pressing the Homescreen and The Lock button.

I have also restored my iPod touch, but it didn't help.

If I'll send it back to apple, if they replace it, will it be replaced with the new Generation iPod touch or will I get the same 2nd Generation one?

Do I have the right to say that I want a new one - I purchased the Apple Care Protection plan with it-

If it's under warranty (which it will be if it's less than a year old), you can take it back to Apple and they will likely exchange it with an identical model if a hardware problem is found.
