Yes, the warranty would be void as you would have to violate the software licesne agreement to install it.

IOS 5, when it is released, will not be compatible with ipod touch 2nd gen.

Hacking is legal. Using a pirated copy of iOS 5 would not be.

When you buy an apple product you should have support till your device is dead and by support i mean updates.

OK, then Apple will charge you twice as much for the device to provide for those "perpetual" updates. And cripple all future updates to allow them to work on old hardware. TANSTAAFL.

How can I do update of the iOS 5 for iPod Touch 2nd gen?

I'm trying at iTunes but I can't do!

I think that only was released for iPod Touch 3rd e 4th gen!
Can you help me?
Thanks!

iOS5 is for 3th generation and 4th generation only .

Your device is now maxed out with the OS that it has on it. Use it as it is.

The same stuff happens to Mac Users : the current OS X Lion does not run on some Macs for example.

Apple is a company that moves quickly in technology. That comes to that price.

dont think its illegal mate and you should not loose your warranty

first: jailbreak was made legal even apple store used to jailbreak device for customers

second: Apples warranty covers the hardware of the device, software isnt a problem even a child can fix an issue with software, it cant be any simpler, all you need is restore and thats it.

but if you use pirate apps that is illegal

Your definition of hacking is very vague and misleading that's not neccessarly true... though mostly it is legal. Also iOS 5 is free software therefore you cannot PIRATE something that's free that's like saying there being a table with free baloons and you take one without asking someone then saying that's stealing, don't be stupid.

Apple doesn't charge me a dime for updates so I don't see what kind of drugs you are on brother, the devices apple sells they put about 50$ of parts at the maximum in and sell them for 200$ they make so much of a markup profit in their sales they should atleast allow us to have all of our devices updated I mean as time progresses on we're on iPod 4G now maybe 1G shouldn't be updated but keep in within range but once say iPod 5G is out kill support for the 2G you see what I'm getting at here? Honestly they don't have to cripple the firmware that badly that shows me how little you know about the development process of software and how much time you've spent dicected an iPod and the firmware it runs on you really have no idea how cheap and flimsy these devices really are inside and out Apple CANNOT complain they aren't making money.

Okay yes as I said before I agree it's not illegal these companies can't make actual laws they sure wish they could do that but anyway, as far as warranty wise their terms that you agree to frequently without even paying attention to it remind you that modding your devices will void your warranty that they are allowed to they're providing the warranty and they're just allowed to do that software can lead to hardware failure and permanant damage to the software bit of your device not allowing it to even boot up and no way to fix it falling under the warranty category if it were software they provided it would be a different story but you took it on your own and modded the device in such a way it was sole your fault and not the companies they would not want to fix your device after that unless you paid them.

Not relevant here, but I just discovered that it apparently isn't compatible with 3rd generation either, even though Apple said it was

iOS 5 runs just fine on my 3rd generation iPod touch. It's only the 1st and 2nd that are left out of the update. And trust me, you wouldn't want iOS 5 on the 2nd gen anyway. My 3rd gen is fater than a 2nd gen, and yet it's still a bit sluggish with some games. Can you imagine what the performance would be on a 2nd gen?
