I have a iphone 3GS unlocked, bought from out of USA, and I still have the OS version 3 since I am not sure that updating to 4.0 will not lock it. Currently I am using it in T-mobile network. Can I update to 4.0 or it will be locked in AT&T ?

Well, this is kind of stupid (the same with the fact that you can not ask a question on their support site , only schedule a repair) 😟. I thought since they sell it unlocked the update will not lock it anymore.
Only the iPhone 4 was sold as unlocked in the US, and not until June of this year. There is no way you have an officially unlocked iPhone 3Gs from the US. And AT&T will not unlock it under any circumstances.
AT&T has never sold/unlocked any iPhone. The unlocked iPhone, available in the US, started with the iPhone 4. The 3GS was never sold as unlocked in the US.
You said you bought it "out of USA" - do you mean you bought it from a store in the USA, or in another country? If it was bought in a store in the USA it is locked to AT&T, so if it works on T-Mobile it was hacked.
According to http://store.apple.com/us/product/MC637?mco=MjU5MjAxMjg iphone 3GS is sold unlocked. I bought ir from a store outside of USA, it is not jailbreaked, just unlocked ( it works on any GSM network)

Apple just started selling that version with the release of the iPhone 4S. Your phone was never sold as officially unlocked in the US & cannot be officially unlocked.
Is everybody blind or unable to read? the OP DID NOT BUY THE PHONE IN THE USA. The 3GS was sold unlocked in many countries. @wjosten, while I am replying to your message I do not mean to single you out. Everyone who responded assumed the OP bought the phone in the USA, in spite of 2 statements that he or she did not.
Actually, the OP did purchase the phone in the US...re-read his/her initial post...the wording may not be the best, but the phone originated in the US.
Only in his second post you are referring to (I bought it outside the USA) is the OP really clear about this, his first post made it look like he did purchase it in the US, especially since he stated he wanted to know if it would relock to AT&T.
After his second one that is why I asked where and when he purchased it. He has not replied.

The information the OP has provided is indeed rather vague, but all indications are that the iPhone was carrier-locked and hacked to unlock it.

If that is the original phone, with original software, and it's unlocked, then when you upgrade it will remain unlocked. Irrespective of where you bought it. The iPhone3GS was released in many countries, unlocked. If (as others have suggested) your phone would be locked to any network when you upgrade then ALL iphone3GS users would be in the predicament.
As part of the update process, iTunes validates the phone with Apple and iTunes will download the correct version for it.
I mentioned it will be locked (not relocked) in AT&T because it is a GSM iphone, and AT&T is the only carrier in USA that sells something like this, so it's logic to lock it to AT&T network.
I bought it from taiwan, I was there a few months sent by my company, and I was not living in US at that time, and the IPhone was not available in my country.
So the question still remains : an unlocked 3GS iphone, bought in another country (not in USA), can it be upgarded to 4.0 or 5.0 and still remain unlocked?
A locked iPhone will lock to whatever network it was originally locked to, not to the closest GSM network.
If it is officially unlocked you have not issues at all, when you updgrade it will not be locked to any carrier.
If it was unofficially locked it will lock to whatever carrier it was previously locked to. Did you buy this iPhone from an Apple Store or from an authorized carrier in Taiwan?
