Hey, I have tried to get iOS 5 for my iPod Touch 3rd Gen but it says that I have the current version, 4.2.1.

iTunes will automatically look for an update on the the 17th October, so will I get it then?

do you have an 8GB 3rd Gen?

because i searched through here a bit and found the iOS 5 update doesnt apply to 8GB 3rd Gen ipod touches, as they are effectively 2nd gen

I have a 8 GB ipod touch 3rd generation and I really do not think that is fair or right. They do not state anywhere that it doesn't work on this model... just not right.

If there is a way to add iOS 5 to this model it would be greatly appriated to be told, thanks.

There is no such thing as an 8 GB 3G iPod.  Apple only made 32 and 64 GB 3G iPOds.  When the 3G iPod was introduced, the 8 GB 2G iPod was continued to be sold with the same iOS as the 3G iPods.  Some sellers misreprented the updated 8 GB2G iPods as 3G iPods. Sorry.

so after reseaching this it appears Apple has tricked us. If you have an 8gb Ipod touch 3rd generation

it is really a 2nd generation software sold as 3rd generation. Only the 32 GB or 64 GB have the true 3rd generation software and only those can get updated to IOS5.

    To help identify :

The iPod touch (3rd generation) can be distinguished from iPod touch (2nd generation) by looking at the back of the device. In the text below the engraving, look for the model number. iPod touch (2nd generation) is model A1288, and iPod touch (3rd generation) is model A1318.

I bought mine 8gb Ipod touch 3rd generation direcclty from Apple and only find out now that it is really a 2nd generation.

    Shame Apple!!

Sort of unfourtunate. And then Apple was also being dishonest because we purchased my 8 GB iPod touch 3rd gen from the Apple store online and it was listed as 3rd generation. Researching deeper (for example on this discussion thread), we find it is indeed only 2nd gen. ***** when Apple is the one being dishonest in their advertising of the product. So I agree with mjtmike: Shame on Apple!

I never saw Apple ever refer to the 8GB iPod touch as "3rd generation". Some dealers did when the 2nd-generation hardware started shipping with iOS 3, but Apple (and I remember looking when this issue first arose) never did refer to the 8GB as 3rd-gen (at that time they didn't refer to "generations" as such as all that I ever could find). I think perhaps you misread or are misremembering.

If you have proof of such a reference, in the form of a web site screen shot, Apple advertisement, etc., contact Apple customer relations and discuss the matter with them.
