No contract would still be locked to the carrier you wanted to use. Full Apple sim free phones are never locked to any carrier. As an example someone who lost a phone with an AT&T contract might buy a contract free one so they aren't paying 2 contracts but it will still be locked to AT&T.
Yes Apple store should be able to sell you a no-commitment (no contract) iphone 4S, it will be more expansive then the discounted price. Starting at 649.00 and if you can afford it that is.
