can not back up to icloud on itouch 3g

I updated my itouch 3g the day iOS5 was released. I was able to create my icloud account and turn it on. But when i select backup it tells me "There was a problem completing the backup. Please try again later" I have been trying like crazy every day since. I did try turning the icloud off then turing it back on it would not let me. So the only way for me to get it back on was to hook it to itunes and turn it on that way.

PS. My dads itouch 3g backed up to the cloud first time.
