Why doesn't volume controls for Powerbeats by Dr. Dre not work w/3gen 64g iPod after IOS 5 update?

I went to the Apple Store Genius bar last Saturday because I had a problem with the headphone jack. Their solution was to either replace with same model or upgrade to new. I chose to replace my 3rd gen 64g with the same model. My old model did not have the IOS 5 upgrade. I used the Powerbeats by Dr. Dre and everything worked fine (before the jack problem). I upgraded the new/replacement model to IOS 5. When I plugged in my Powerbeats by Dr. Dre, the volume control buttons did not work. All the other functions (play/pause/forward/backward) work. The headphones are only 3 weeks old. I tested the headphones on my husband's iPhone 4s and they work fine. I tested the stock Apple remote headphones and they work fine. I've done a reset, a restore, and applied the newest upgrade and none of that worked. I would appreciate any help. These headphones are not cheap. I use them for my workout sessions. The Apple headphones do not stay in my ears. Thanks in advance.
