Setup iPhone 4s

Do an update on your 3GS to IOS5 and backup to computer's iTunes. With new 4S do a restore with iTunes.

Did you read the support article I referenced? After you restore from backup, you MUST sync to restore your iTunes content. Your iTunes content should be in your iTunes library, just sync it to your new phone.

That is an activation lock. If you do not know the prior owner of the phone, you will never be able to use the phone. If possible, return it for a refund.

Without the prior owners help, there is nothing anyone can do to help you. If you cannot return it for a refund, then you lost your money.

Only the person who initiated the Activation Lock can remove it. If you cannot

find that person, the iPhone is useless. Apple will not help as you are not

the original purchaser of the iPhone. T-Mobile Germany mis-informed you.

There is no workaround for Activation Lock.
